The house I live in with my husband is in trust to his kids. How long can I stay in the house if my husband precedes me in?
The house was put in an irrevocable trust by my husband’ and his deceased wife years before we married.
Answer: You likely have no entitlement to remain in the house if he dies before you, especially since the house was placed in trust by his late wife. It’s unlikely that he granted you a residence privilege in the trust. To determine your rights regarding continued occupancy, you will need to review the actual trust document.
In my experience, stepchildren are generally not very generous in these situations, though there could be exceptions. If it turns out that you do not have a legal right to stay in the house, the children would need to initiate an eviction process to remove you. This process can take several months.
